America...British....whatever. It was probably just poor choice of words on my part, the point was that the people thought there were being filmed for a documentary for Kazakstan (sp?), which turned out to be false.
Regardless, shouldn't any contract legally have to disclose all information pertaining to the particular project? And if so, if you sign it without reading it, I believe that you are still at fault and should not be able to seek legal recourse.
And regarding the car salesman...if it were me, I would have just refused until they agreed to stop filming and given me a chance to look everything over. Worse case scenario? They stop filming and leave. Or they keep filming without you having agreed, and THEN you have a legal case. I believe that it was still shame on him. |

I'll have to see if I can find any cases regarding lying about the content of a contract and how it relates to informed consent, but as far as I have been made aware, the law protects those who are lied to about the content of a contract. I haven't seen the contracts for "Borat" yet, but I would suppose that if they're really tricky bastards they didn't include more than a simple release without detailed information, so that if you actually read the contract it doesn't say exactly what's going on other than you releasing your likeness to be used in X film. If the written contract is bolstered or amended by an oral contract, and that oral contract is false, then the written contract is also on its face false (as far as I am aware of contract law).
I've seen that one happen a lot - the post-secondary school at which I taught was often threatened with lawsuits from night students who were told things by admissions reps that directly contradicted the written contract - our corporate attorney sent out an e-mail reminding us that anything said in the process of signing a contract can be considered an amendment to that contract. |

but here is the hard part...if the contract gives explicite covers for certain things it is the signers obligation to read it and sign or not. I pretty sure that as much money as this movie is making the contracts are well written. And misrepresentation is probably not a wise choice of law suits. As they would have to prove they were misquoted or certain shots were edited to make something appear a certain way. As all the footage is most likely still held somewhere...it's probably not gonna fly. |
