"We understand now that file-sharing the music was illegal," Torres said in a statement distributed by the recording industry. "You can be sure Brianna won't be doing it anymore."

Brianna added: "I am sorry for what I have done. I love music and don't want to hurt the artists I love."

The case against Brianna was a potential minefield for the music industry from a public relations standpoint. The family lives in a city housing project on New York's Upper West Side, and they said they mistakenly believed they were entitled to download music over the Internet because they had paid $29.99 for software that gives them access to online file-sharing services.

Even in the hours before the settlement was announced, Brianna was emerging as an example of what critics said was overzealous enforcement by the powerful music industry.

The top lawyer for Verizon Communications Inc. charged earlier Tuesday during a Senate hearing that music lawyers had resorted to a "campaign against 12-year-old girls" rather than trying to help consumers turn to legal sources for songs online. Verizon's Internet subsidiary is engaged in a protracted legal fight against the RIAA over copyright subpoenas sent Verizon customers.

Sen. Dick Durbin, D-Ill., also alluded to Brianna's case.

"Are you headed to junior high schools to round up the usual suspects?" Durbin asked RIAA President Cary Sherman during a Senate Judiciary hearing.

Durbin said he appreciated the piracy threat to the recording industry, but added, "I think you have a tough public relations campaign to go after the offenders without appearing heavy-handed in the process."

Sherman responded that most people don't shoplift because they fear they'll be arrested.

"We're trying to let people know they may get caught, therefore they should not engage in this behavior," Sherman said. "Yes, there are going to be some kids caught in this, but you'd be surprised at how many adults are engaged in this activity."

You could countersue the record industry for invasion of privacy, hacking into your computer, and stealing information from your computer.

w00t, hopefully my step dad will get it in the neck for all the files shared on kazaa on his comp that are actually down to me, everythings in his name, and id love for something to happen to him, afterall no one beats up my mum and gets away with it!

Well it falls under the whole Probable Cause. If they think they have enough to warrant a seizure they can.

Mostly that falls under an ISP turning your IP over to them to run a trace against this "list" they have.

But for the love of god, get Kazaa Lite K++ if you HAVE to use Kazaa, it blocks RIAA IP's and a load of others.

umm...to just say somethin that referrs to what AZ said WAY earlier: ON the news, it has been told that they will also sue / whatever the hell RIAA does if they catch you also dling porn. Tough luck AZ Very Happy

Also, Ain has the perfect measure of action: Finding out if you DL lots of music and share it is an invasion fo your privacy. Personaly, the only thing i can say that they can do is go into Kazaa or somethin, pick a random song or whatnot, and see how many times the same name pops up with the same user. So in theory, its really not that well thought out, because lal you have to do is just make sure that you dont share your files. They wont know that you are DLing them, and thus for, you wont get charged. But im gonna lay low on my DLing, and wait this thing out, and see what happens

Also, that article above was probably some BS story that the RIAA made up to make people think that u should give up easily. I mean, cummon, no kid will go "Oh...i didnt know it was illegal, and i didnt want my favorite bands to get hurt" Cummon...even a 12 year old has the sense enough to know that what they are doin isnt hurtin the band. And what hte mom said...my GOD! 95% of home parents that dont work with comps for a living have no clue what the hell file sharing is, nor do they give a rats ass who does it.

Actually they were paying for Kazaa, per month or something, and they didn't read the EULA I would assume that probably says somewhere in there to the effect of "We give you the software to find whatever, but whatever you do with it isn't our business"

It is an invasion of privacy, and the RIAA is just out to destroy lives. Until someone stops them though, I'd be careful just to be safe you know?

this entire thing is rediculous. and jester, it does come down to prices, why in the world should i pay $15-20 just to get a cd that i probably only like half the songs on at most? i rarely find a cd i truly love every song on, so whats the point of paying for it if i can get it for free on the computer and save my money for other things, such as concert tickets.

next thing you know, the RIAA will be suing garage bands for distributing their music on the net in an attempt to get recognition.
