The only potential problem is a judge that looks the other way and an appeals judge that's not willing to hear the case. The law should have been shredded on the committee floor, and I'm fairly certain a judge will weedwhack it, but there's a chance, always a chance...

As for Mr. Thompson's "advice" and reasoning, he's clearly prejudiced against video games - this should be noted and considered in any reviews of his ability to practice law.

Last Friday, Minnesota Governor Tim Pawlenty signed a bill restricting game sales into law. Though it was immediately challenged in court by the Entertainment Software Association, its rather mild terms didn't exactly sow panic among gamers. The law would fine minors who attempted to buy Mature- and Adults Only-rated games $25 and ask game retailers post a sign warning of the fine in their stores.

Late yesterday, another game bill moved one step closer to law in Louisiana. However, the measure has stirred up a much larger controversy in the industry for two reasons: its draconian terms, which are based on previously upheld obscenity laws, and its coauthor, vociferous antigame activist Jack Thompson.

Written by Representative Roy Burrell (D-District 2) and Thompson, HB1381 would make it illegal to sell, rent, or lease a game to a minor if it met three conditions. First, if the "average person" would think "appeals to the minor's morbid interest in violence." Second, if it "depicts violence in a manner patently offensive to prevailing standards." Lastly, a game would only qualify if it "lacks serious literary, artistic, political, or scientific value for minors." Violators could be fined between $100 and $2,000 and sentenced to up to 12 months in a state prison.

After being approved by a key committee last week, HB1381 was passed last night in a 35-0 vote in the Louisiana State Senate, according to watchdog site GamePolitics.com. The bill will now be presented to Democratic Governor Kathleen Blanco, who made national headlines during the disastrous aftermath of Hurricane Katrina last fall. The Governor is expected to sign the bill, given the unanimous vote and the recent linking of games and teenage murder suspects in the Louisiana media. If that happens, expect an ESA legal filing to follow shortly.

You'd think if this kinda law already got shot down in four states, that this one would follow suit. Also the wording on that bill is f'd up. They could pick any "average" person they want, and it'd hardly be the average person.

I pray that the appellate process goes quickly and smoothly.

This whole thing reminds me of the CDA back in the days of the Internet's youth - a bill passed in redundancy with existing laws (note that the wording in the Louisiana bill is very similar to that of most obscenity ordinances) in order to further regulate a form of media that already falls under the pre-existing laws.

So what's the point of a law like this? Simple. It's a call for class-action lawsuits. Since this bill only builds on existing laws, while directly pointing the finger at a specific industry, it's like a free ad for Thompson - even better, an ad that the state of Louisiana will pay for in legislator's salaries and court time. Not to be too much of a conspiracy theorist, but the plan seems simple and somewhat obvious. I present to you The Devil's Checklist.


  1. Drum up Fear, Uncertainty, and Doubt (FUD) in parents and grandparents by calling games "pornographic" and "obscene". Done
  2. Lie openly about the content of games in order to downplay any artistic value a game may have, while playing up the violent and sexual aspects of any game in existence. Done
  3. Make claims about the game industry's labeling practices and claim that every failure of the ESRB to properly label a game (Oblivion1) is turned into a nefarious plot to hurt our children. Done
  4. Jump on every violent crime and claim that only video gamers will commit these crimes in these ways. Done
  5. Pass bill that makes it illegal to sell certain video games to minors. Use wording from obscenity laws. Done
  6. Pigeons Concerned citizens will now band together and refer to games as obscene, therefore fulfilling the "average person" part of the test.
  7. Play buddy-buddy with game stores; tell them that the game industry's "poor labeling practices" is putting them at risk of running afoul of new law.

And the denoument (unfortunately, this part I can't only blame on Thompson):

  1. Use support from group of "average citizens" and existing laws to sue games industry for huge amounts of money.
  2. Settle. Allow industry to pay class members in coupons. Take 60% in cash.


1According to Bethesda and Take-Two, the papers they filed with the ESRB indicated the maximum possible warning for violence, which the ESRB ignored and under-labeled. The ESRB then claimed, upon finding out there was a nipple hidden in a mesh, that Take-Two failed not only to divulge the "sexual" content, but that the game was also "more violent" than previously mentioned.
